Mark is part of the firm's Energy & Clean Technology Practice, which serves more than 250 clients. Mark primarily focuses on U.S. and international project finance and private placement representation of renewable and conventional energy, clean technology, environmental and  infrastructure clients. His clients principally represent developers, lenders, EPCs, O&Ms, equipment providers, private equity, venture capital and infrastructure funds.

In his more than 35 years of practice, Mark has represented clients in all aspects of domestic and international energy and infrastructure project development and financing including the negotiation and drafting of fuel, power, EPC, O&M, concession, other infrastructure, and debt and equity contracts; mergers and acquisitions; investment fund structuring and related investments therefrom; private placement structuring and related venture capital and private equity contracts; and compliance with related regulatory and legislative issues. He also has represented clients in international disputes before U.S. and foreign agencies, dealing with matters such as export controls, sanctions, and anti-bribery related to these transactions. Before joining Mintz Levin, Mark was a partner at another prominent national law firm, where he led two practice groups focusing on Renewable Energy and Clean Technology and India and South Asia.

Mark has counseled renewable and conventional energy clients doing business in more than 50 countries, including Argentina, Bangladesh, Brazil, Chile, China, Costa Rica, Cote d’Ivoire, the Czech Republic, Dominican Republic, Egypt, El Salvador, Haiti, Hungary, India, Indonesia, Iraq, Israel, Jamaica, Kazakhstan, Malaysia, Mauritius Islands, Mexico, Nepal, Nigeria, Oman, Pakistan, Panama, Philippines, Poland, Russia, South Korea, Sri Lanka, Taiwan, Thailand, Turkey, the United Arab Emirates, and Venezuela.

Mark is a Founder and General Counsel of the American Council On Renewable Energy (ACORE), the largest domestic and international association of renewable energy and clean tech businesses. He has led the DC Technology Funders, a monthly breakfast meeting that brings together up to 40 venture capital and private equity funders for presentations by new clean tech companies seeking funding. Mark also has served as General Counsel and a longtime board member for the US-India Business Council, the largest US-India business association.

  • Representing a U.S. energy company in the project financing of a $2 billion natural gas-to-liquids project with related processing units, pipelines and other infrastructure in Africa
  • Representing a U.S. company in the project financing of a $7.7 billion natural gas-to-clean jet fuel project with related solar power, pipelines, water desalinization and other infrastructure in the Southwest U.S. As part of this representation, the largest volumetric and longest term biojet offtake agreement has been executed, with three similar agreements in negotiation and drafting
  • Representing a U.S. company in the project finance of $850 million waste-to-green gasoline projects in Massachusetts and California
  • Represented a U.S. biogasification client in the closing of a Series B funding round
  • Represented a U.S. advanced biofuels company in the closing of a Series C funding round
  • Representing a micro wind turbine manufacturer in a 1500 unit equipment finance in India
  • Representing a U.S. biogasification company in the project financing of facilities in Hungary, Poland and India
  • Represented 12 out of 12 U.S. and foreign energy company clients to the exclusion of all FY2010 and FY2011 applicants in reaching the finals and then 10 of those finalists, to date, to become awardees of USDA conditional loan guarantees for U.S.-based integrated advanced biofuel and biochemical refineries, including biopower plants. Of these awards, 3 are financially closed using first-ever credit enhanced project bonds and 7 are in closing mode as part of a series of project financings
  • Represented 4 out of 4 client awardees in the receipt of U.S. Navy Phase 1 investments for first commercial biojet projects with 5 total awards out of more than 100 RFP applications, as part of the initial rounds of project financings
  • Represented a public U.S. biopower company in the acquisition of 1.5 MW and 18 MW biomass-to-power facilities in India
  • Represented more than 15 U.S. and European energy companies in renewable power and advanced biofuels grants and energy loan guarantee award transactions before the DOE
    Representing a consortium of U.S. advanced biofuels companies in the creation of an EPA qualified biomass feedstock pathway between Canada and the U.S.
  • Representing a U.S. advanced biofuels company in the creation of a U.S. biomass pathway
  • Represented a U.S. advanced biofuels client in the qualification of a new fuel pathway for renewable gasoline
  • Represented a U.S. energy company in securing a DARPA R&D grant for a new alcohol-to-jet certification

  • Representing a U.S. geothermal corporation in the development and project finance of geothermal power projects in the US Virgin Islands, Dominican Republic, Chile, and Texas and California
  • Represented a major U.S. agricultural processing company in multiple transactions involving the purchase, dehydration, and sale of fuel ethanol between Latin America and the United States
  • Represented two major U.S. and European funds in their Series A equity investment into a Mauritius hydroelectric holding company for further investments into multiple Indian hydroelectric projects as part of related project financings
  • Represented two major U.S. real estate firms and a Mauritius investment fund in their Series A investment into an Indian real estate development company for the development and construction of an integrated residential and IT township
  • Represented a U.S. oil trading company in the manufacture of 5,125 solar-powered water purification units for installation in India, Greece, and various countries in Africa and Latin America
  • Represented a U.S. venture capital client in the acquisition, finance, and conversion of a vegetable oil processing plant into a 50 million gallon per year biodiesel manufacturing facility in India — the first financial closing of a biodiesel project in India
  • Represented a major Indian private equity company in its investment into a 30 million gallon per year biodiesel facility in India — the second financial closing of a biodiesel project in India
  • Represented a major U.S. construction company in the project finance of the 2600 MW LNG-fired Dabhol power project, LNG port, two LNG regasification units, desalinization plant, pipelines and related infrastructure in India
